June 27, 2018

Thellman called the regular meeting to order at 4:00 p.m. on Wednesday, June 27, 2018 with all members present.

MINUTES 06-27-18

Thellman moved approval of the following minutes:  May 9, May 16, May 30, June 6 and June 13, 2018. Motion was seconded by Derusseau and carried 3-0.

 

CONSENT AGENDA 06-27-18

Thellman moved approval of the following Consent Agenda:

►  Commission Order Nos. 18-31 and 18-32 on file in the office the County Clerk); and

►  Second Amendment to the Agreement for the provision of inmate

health services with Advanced Correctional Healthcare, Inc.

Motion was seconded by Derusseau and carried 3-0.

LAND ATTACHMENT 06-27-18

The County Commission conducted a public hearing to receive comment and act on a petition to annex property to Rural Water District No. 5. The lands sought to be attached are described as follows:

The West Half of the Northeast Quarter of Section 30, Township 13 South, Range 20 East of the 6th Principal Meridian, Douglas County, Kansas.

Quentin Kurtz, Stumbo Hanson, LLP, representing Rural Water District #5, was present for questions. Because the property in question lies within the three mile fringe area of the City of Lawrence, the County Commission is required to receive testimony.

Thellman moved to open a public hearing to receive comment. Motion was seconded by Gaughan and carried 3-0.

Branden McGuire, Assistant to the City Manager, stated there is potential for urban growth in this area. The City is willing to consider an agreement for the reasonable, orderly transition of rural water service to city services as Lawrence expands into the area. McGuire noted there would be a cost to taxpayers to bring the infrastructure up to urban standards should annexation take place.

Thellman asked McGuire for clarification that the City has no opposition to the petition. McGuire responded that is correct.

Thellman moved to close the public hearing. Motion was seconded by Gaughan and carried 3-0.

Thellman moved to approve the attachment of lands as legally referenced above to Rural Water District No. 5, noting all requirements from all parties had been met. Motion was seconded by Gaughan and carried 3-0.

ACCOUNT PAYABLE 06-27-18

Thellman moved to approve accounts payable in the amount of $316,896.09 to be paid on 06/28/18; and payroll in the amounts of $2,128.02 paid on 05/11/18, $2,087.63 paid on 05/25/18, $1,046,924.48 paid on 06/08/18 and $1,018,557.17 paid on 06/22/18. Motion was seconded by Derusseau and carried 3-0.

PUBLIC COMMENT 06-27-18

Ron Wilson, 627 North 750 Road, stated he filed three complaints with the County and feels his complaints have not been validated. The subject of the complaints was not defined.

Thellman moved to adjourn the meeting. Motion was seconded by Gaughan and carried 3-0.
