Thellman called the regular meeting to order at 4:00 p.m. on Wednesday, April 25, 2018 with all members present.
PROCLAMATION 04-25-18
Thellman read and moved to approve a proclamation declaring May 2018 as “National Preservation Month” in Douglas County. Motion was seconded by Gaughan and carried 3-0.
CONSENT AGENDA 04-25-18
Thellman moved approval of the following Consent Agenda:
► Commission Order No 18-21 on file in the office the County Clerk);
► Participating in the Outreach, Prevention and Early Intervention Services Program with the Lawrence-Douglas County Health Department for a funding match of $225,000; and
► Authorized staff to close Fund 231, for Economic Development (created by Resolution 88-13) and transfer the remaining balance to Fund 100, the General Fund.
Motion was seconded by Derusseau and carried 3-0.
WALK-ON ITEM/UPDATE 04-25-18
Sandra Dixon, DCCCA; and Jason Hess, RADAC; provided the Board with an update on the substance abuse component of the ICT Team and opioid crisis.
In the social detox project since March 2, 2018, DCCCA has had 20 calls from the hospital, 10 in March and 5 in April, and received two calls on two individuals. DCCCA has made 15 placements. Two of the people have been placed twice meaning the first time around they refused treatment, but came back around. Five chose no detox. The majority came to the ER for alcohol related complications, and a few for meth, and one for a controlled substance. Of the 15 placed, 10 completed detox, two were admitted to a men’s facility in Wichita, four had appointments in outpatient facilities but didn’t show up
Hess gave a snapshot of the Heartland Regional Alcohol and Drug Assessment Center (RADAC) care coordination received in Douglas County. From March 1 to April 19, 2018, 52 individuals were referred to Heartland RADAC in 6 weeks for Intensive Coordination Services. The majority were residents of Douglas County, 6 came from DCCCA, 44 were referred from LMH, 19 were active the internal intensive care program and the rest refused treatment; 14 of the 19 were identified as having a substance abuse problem; 8 have been assessed and are in treatment programs. Much of the care will be funded through the Federal Block Grant which is a limited pool of money for care and treatment. Through the end of March 2018, RADAC has done a total of 115 assessments here in Douglas County.
According to Dixon and Hess, Meth is the drug of choice at 54% in Douglas County and is also a statewide and regional problem.
No action was taken.
PUBLIC WORKS 04-25-18
The Board considered awarding a contract for CIP Bridge Replacement Project No. 2014-66 for Bridge replacement No. 12.15N-17.50E. Chad Voigt, County Engineer, presented the item.
Voigt stated Public Works received six bids. He asked the Commission to approve the low bidder, Ebert Construction Company. He noted that the apparent low bidder at the bid opening was Pfefferkorn & Dury Construction. However, they had an error in their bid that increased their bid by $2,388.75. This error resulted in their being the second lowest bidder.
Voigt said the contract documents for this project require detailed design of the bridge structure to be performed by a contractor-consultant team. Douglas County provided detailed bridge design specifications that Ebert Construction's proposal meets. They proposed a 44'-span bridge with concrete bridge deck on steel superstructure on concrete abutments founded on deep piling. Voigt said this will be a quality bridge. Ebert Construction's design engineer is Pfefferkorn Engineering & Environmental with whom we have worked and are comfortable.
Thellman opened the item for public comment. No comment was received.
Thellman moved to approve the construction contract for Project No. 2014-66, the replacement of Bridge No. 12.15N-1750E, to Ebert Construction, Inc. for the low bid amount of $425,102.50, and authorized the Public Works Director to approve change orders totaling up to 10% of the contract amount. Motion was seconded by Gaughan and carried 3-0.
LONE STAR LAKE 04-25-18
Sarah Plinsky, Assistant County Administrator, presented the following item.
Douglas County has received concerns from citizens regarding the condition of docks, decks and similar structures on private and public property at Lone Star Lake. In response, Zoning and Codes has completed an on-site inspection survey of current docks and construction on county property and is prepared to host a public discussion on this issue.
In September of 2017, Zoning and Codes staff completed the on-site inspection. Structures identified were floating and pier supported docks, sheds, outbuildings and deck retaining walls. After that survey, staff drafted a set of Lone Star Lake Rules and Regulations that will define floating and stationary docks, permanent improvements and the permitting process for these structures under Chapter 13 of the Construction Code. A Dock and Swimming Platform Specification and Criteria sheet has also been drafted to provide guidance on new construction of docks; approved materials, size requirements, anchoring process, and prohibited uses; such as petroleum storage, dredging without approved permits, fill material, etc.
Staff is proposing a new Zoning District to address the unique nature of properties at Lone Star Lake. The LS (Lone Star Lake Lot Residential) District recognizes the lake lots or tracts previously created by plat within Douglas County at Lone Star County Lake, which are unique and distinctive from other county developments. The zoning regulations will address realistic setbacks for new construction, eliminating reoccurring Board of Zoning appeals cases for setback variances on these small lots.
Staff recommends approval to host a public meeting to present these concepts to landowners, and to hear their comments and recommendations. We’ll work with the Lone Star Association to schedule the meeting and notify residents by mail. Staff then come back to the Commission with additional information gathered to proceed with final approval.
The public meeting for input has been scheduled for May 10. The draft construction regulations for docks will be presented.

Brian Harris, Lone Star Lake resident, asked when the public meeting would be held. Sean Reid, Director of Zoning and Codes, responded 6 p.m., May 10, 2018 at the Lone Star Community Building. Notification will be sent out to Lone Star Lake property owners.
No action was taken.
ACCOUNT PAYABLE 04-25-18
Thellman moved to approve payroll in the amount of $305,778.53 to be paid on 04/26/18. Motion was seconded by Gaughan and carried 3-0.
