(2) Hearing regarding the initiated process to vacate a portion of an alley in the town site of Vinland lying between lots 3 and 4 (Michael Kelly)

(3) Request for a one-year extension to the approval of CUP-15-00229: Conditional Use Permit for Burning Barrel, a specialty butcher shop, located on approximately 30 acres at 292 N 2100 Road. Request submitted by Brian Strecker, Burning Barrel LLC, property owner of record. Approved by the BoCC on 8/12/15. Mary Miller is the Planner.

Gaughan called the regular meeting to order at 6:00p.m. on Wednesday, August 30, 2017 with all members present.

PROCLAMATION 08-30-17

Gaughan moved to approve a proclamation honoring September 10-16, 2017 as “First Responder Week.” Motion was seconded by Derusseau and carried 3-0.

Jayda Jackson from Schwegler Elementary was the winner of the First Graders for First Responders coloring contest for showing her appreciation for the selfless men and women who serve Douglas County.

CONSENT AGENDA 08-30-17

Gaughan moved approval of the following Consent Agenda:

►  Received the 2016 County Engineer’s Annual Report submitted to KDOT.

 

Motion was seconded by Thellman and carried 3-0.

PUBLIC WORKS 08-30-17

The Board conducted a public hearing regarding the initiated process to vacation apportion of an alley in the townsite of Vinland lying between lots 3 and 4. Michael Kelly, County Surveyor, was present for questions.

Gaughan moved to open the public hearing to accept comment on the initiated alley vacation. Motion was seconded by Thellman and carried 3-0.

No comment was received.

Gaughan moved to close the public hearing. Motion was seconded by Thellman and carried 3-0.

Gaughan moved to adopt Resolution 17-30 vacating a portion of an alley within the Vinland townsite. Motion was seconded by Thellman and carried 3-0.

PLANNING 08-30-17

The Board considered a request for a one-year extension to the approval of CUP-15-00229, a Conditional Use Permit for Burning Barrel, a specialty butcher shop, located on approximately 30 acres at 292 N 2100 Road. The request was submitted by Brian Strecker, Burning Barrel LLC, property owner of record. The application was approved by the Board of County Commissioners on 8/12/15. Mary Miller, Lawrence-Douglas County Metropolitan Planning Staff, presented the item. 

Per Section 12-319-2 of the Zoning Regulations, if a building permit is not obtained for the site within one year of the Commission’s approval of the CUP application, the approval becomes null and void unless an extension is required prior to that date. Miller stated this is the second request for extension. The business is not currently operating. Requirement for the CUP have been met though the parking and driveway has not been installed and cannot until the building is complete. According to the applicant the building is unique and taking longer than expected.

It was the consensus of the Board that the applicant is genuine in his request and working toward an end product.

Gaughan opened the item for public comment. No comment was received.

Gaughan moved to approve the request for a one-year extension to the approval of CUP-15-00229; Conditional Use Permit for Burning Barrel. Motion was seconded by Thellman and carried 3-0.

ACCOUNT PAYABLE 08-30-17

Gaughan moved to approve accounts payable in the amount of $460.00 to be paid on 08/31/17. Motion was seconded by Derusseau and carried 3-0.

APPOINTMENTS 08-30-17

Thellman moved to appointments to the Heritage Conservation Council:  Kimberley Mahanna-Bellemere to replace the unexpired term of Kurt von Achen; and Douglas McRoberts McKean to fill the expired term of Ken Grotewiel. Motion was seconded by Derusseau and carried 3-0.

 

Gaughan moved to adjourn the meeting. Motion was seconded by Derusseau and carried 3-0.
