Flory called the regular meeting to order at 08:15 a.m. on Wednesday, July 13, 2016 with all members present. 

BUDGET 07-13-16

The Board conducted 2017 budget hearings. No action was taken.

Flory moved to adjourn the meeting until 6:00 p.m. Gaughan seconded and the motion carried 3-0. 

The Board recessed until 6:00 p.m.                                                                                                                                                        

RECONVENE

The Board reconvened at 6:00 p.m.

CONSENT AGENDA 07-13-16

Flory moved approval of the following Consent Agenda:

►  The Board acknowledged receipt of quarter reports from the Register of Deeds office; and

►  Authorized the Public Works Director to approve a contract with  Pfefferkorn & Drury Construction, LLC in the lump sum amount of  $18,620.00 for concrete sawing services and crane services for Project  No. 2010-08, the rehabilitation of Bridge No. 12.65N-23.87E.

Motion was seconded by Gaughan and carried 3-0.

PUBLIC WORKS 07-13-16

Keith Browning, Director of Public Works, asked the Board to consider approving a road maintenance agreement between Douglas County and Hamm, Inc. for E 500 Road south of Route 442 (N 1600 Road). 

In addition to Hamm being responsible for one full dust palliative treatment and any required dust control measures, Browning proposed Hamm pay Douglas County a road maintenance fee of $0.25 per ton of rock hauled from the quarry. Douglas County would use the proceeds to maintain the road when it deems appropriate. The current rock donation requirement would also remain in the agreement.

Flory opened the item for public comment. No comment was received.

Flory moved to approve in concept a revised Road Maintenance Agreement with Hamm, Inc. for maintenance of the haul road for Bucheim Quarry regarding Route 1029 from Route 442 to the entrance of the quarry. Motion was seconded by Thellman and carried 3-0.

PLANNING 07-13-16

Mary Miller, Lawrence-Douglas County Metropolitan Planning Staff, presented the 2015 annual review of Hamm Buchheim Quarry at 1453 E 500 Road. Staff found the Hamm/Buchheim Quarry to be in compliance with the conditions and restrictions of the Conditional Use Permit.

Miller listed the following conditions met as follows:

• Entrance to site from County Road 1029 (E550) was constructed to standards and specifications set by the County Engineer;

• Established Maintenance Agreement for E 500 Road for dust palliative and cost of maintenance;

• Top soil stockpile in the “no mining” area was reduced in height and vegetation has been established;

• Crushing was revised to 120 consecutive calendar days and it was determined equipment can remain on site. There was no quarrying in 2015;

• The stockpile within 75 ft of the property line was pulled back and the berm installed in the southwest corner;

• The crushing area has been fenced with 5-strand barbed wire and “no trespassing” signage has been placed at a maximum of 500 ft intervals; and

• Berming on the north was found to be consistent with the conditions, meeting the intent to screen the quarry from rights-of-way and neighboring properties.

Flory opened the item for public comment.

Stephen Freider, 521 N 1450 Road, stated the fencing wire was not completed until March 2016 after bringing it to the Planning Department’s attention. He would like staff to confirm an ending date for quarrying. He proposed making a 50-year life term for the quarry.

Niki Schneider, 515 N 1500 Road, said she would like Hamm to consider providing a pre-blast survey. She receives no notification when they will be blasting and is concerned the blasting will cause damage to her house. She also feels the road maintenance for E 550 Road should solely be the responsibility of Hamm.

Keith Browning responded that the new maintenance agreement of $0.25 charge per ton of rock hauled will provide coverage to stabilize the road, in addition to Hamm providing dust palliative treatment. Mowing and snow removal is not the responsibility of Hamm.

No action was taken.

ACCOUNTS PAYABLE 07-13-16

Flory moved to approve accounts payable in the amounts of $263,331.69 to be paid on 07/14/16 Motion was seconded by Thellman carried 3-0.

Flory moved to adjourn the meeting. Motion was seconded by Thellman and carried 3-0.
