May 25, 2016

Flory called the regular meeting to order at 4:00 p.m. on Wednesday, May 25, 2016 with all members present. 

PROCLAMATION 05-25-16

Flory moved to approve a proclamation declaring May 2016 as Mental Health Month in Douglas County. Motion was seconded by Thellman and carried 3-0.

CONSENT AGENDA 05-25-16

Flory moved approval of the following Consent Agenda:

►  Resolution 16-15 granting a license to sell cereal malt beverages at Clinton Marina for a Special Event held on June 18, 2016;

►  Addendum to HCC Grant Agreement KU Center for Research, Grant HCC 2014-15 passing the remaining 70% of grant fund balance to pass through Freedom’s Frontier natural Heritage Area’s office for the  “A Systematic Inventory of Natural Areas and Habitat in Douglas County” project;

►  Approval of Freedom’s Frontier National Heritage Area Pass Through Program for Partners- Creation of a non-competitive program;

►  Acquisition of Easement for drainage structure replacement Project No. 2014-64; Structure No. 19-76N-16.00E: Ronald Schneider and Margaret A. Farley, Lawrence, Kansas, Tract No. 1; James E. Medaris, Lawrence, Kansas, Tract No. 2; and Maurice R. Woodsoncroft, Lawrence, Kansas, Tract No. 3;

►  Authorization for the Public Works Director to sign the Request to Exchange Federal Funds form notifying KDOT that Douglas County wishes to exchange our current balance of federal funds for state funds at the exchange rate of $0.90 state funds per $1.00 federal obligation authority funds; and

►  Request to amend the contract with Advanced Correctional Healthcare to 1) reallocated the nursing and certified medical technician services cost portion of the contact to the pool of money which will increase the $75,000 pool to $420,000 (Articles 1.18, 1.21.2 and 1.21.4);and  2) Add language to limit an annual increase to not exceed three percent  (Article 3.1.1)

Motion was seconded by Gaughan and carried 3-0.



PLANNING 05-25-16

Gaughan moved to approve a request for a one-year extension to the approval of CUP-15-00060; Conditional Use Permit for a micro-distillery, located at 1743 N 200 Road, Baldwin City, Kansas as requested by William and Glynnis Murphy, owners of Sunwise Turn Farms, LLC, property owners of record, based upon recommendation by staff. Motion was seconded by Thellman and carried 3-0.

PLANNING/ZONING 05-25-16

The Board considered TA-15-00461, Text Amendments to the Zoning Regulations for the Unincorporated Territory of Douglas County, Kansas and the Subdivision Regulations for Lawrence and the Unincorporated Areas of Douglas County, KS to add Accessory Dwelling Units as a permitted use and to establish standards for the use, as tabled from the May 18, 2016 meeting for language revisions. Mary Miller, Lawrence-Douglas County Metropolitan Planning Staff, presented the item.

Per the May 18, 2016 meeting, staff revised the language to require the accessory building be tied to a family caregiver/farm employee based need for a three-year period before the accessory building could be rented out.

Gaughan asked what process would be used if someone wants add a second driveway. Keith Browning, Director of Public Works, replied a second residence entrance must meet full frontage requirements. A local road would require 250 feet of frontage for a driveway, so to have a second entrance they would have to have 500 feet of frontage. Browning said the County may need to look at the access management regulations at a future date.

 

Flory asked after building the accessory dwelling if a property owner would have to go through the entire application process which includes meeting septic system if he wished to sell one of the dwellings. Miller responded yes, they would have to go through the certificate of survey process and go through all the standards including meeting road frontage, but when feasible, she would like to see the owners allowed to unitize existing driveways.

Flory opened the item for public comment. No comment was received.

Flory moved to approve the language presented and incorporated for TA-15-00461, Text Amendments to the Zoning Regulations for the Unincorporated Territory of Douglas County, Kansas and the Subdivision Regulations for Lawrence and the Unincorporated Areas of Douglas County, Kansas to add Accessory Dwelling Units as a permitted use and to establish standards for the use. Motion was seconded by Thellman and carried 3-0.

PUBLIC WORKS 05-25-16

The County Commission held a public hearing regarding the 2017 Road Maintenance Budget for the Hesper Charter Road Improvement District (CRID). Keith Browning, Director of Public Works, provided the Board with the history on the benefit district and his recommendations for future budgets.

In 2016, the maintenance budget was set for $40,000, with previous discussions determining to keep the maintenance budge fairly constant until 2017 when the capital improvements assessments expire. Browning proposed an increased maintenance budget of $52,000 for 2017, and $54,000 annually from 2018 through 2023. Browning provided a spreadsheet showing the calculated amount to be contributed by each individual property owner for 2017 and a contribution of $39,245 from Douglas County toward the total budget of $52,000.

 

Flory opened the item for public comment. No comment was received.

Thellman moved to approve the 2017 Road Maintenance Budget for the Hesper Charter Road Improvement District at $52,000. Motion was seconded by Gaughan and carried 3-0. 

ACCOUNTS PAYABLE 05-25-16

Flory moved to approve accounts payable in the amount of $657,418.852 paid on 05/26/16. Motion was seconded by Thellman carried 3-0.

Flory moved to adjourn the meeting. Motion was seconded by Thellman and carried 3-0.
