Interstate Compact

Transfer of supervision promotes public safety by ensuring that defendants are monitored in the community where they live. It also gives the defendant the opportunity for rehabilitation in his/her community.

Interstate Transfer

The transfer of supervision from one Kansas jurisdiction to another Kansas jurisdiction. These transfers are initiated by and at the discretion of the Supervising Officer assigned to monitor the defendant in the jurisdiction in which he/she was adjudicated. All intrastate transfer requests are allotted a 30 day investigation period which is completed by the jurisdiction receiving the request. The receiving/investigating jurisdiction will determine whether to accept the transfer or not.

Interstate Compact

The transfer of supervision from Kansas to another state. These transfers are referred to a Interstate Compact Officer at the discretion of the Supervising Officer assigned to monitor the defendant in the jurisdiction in which he/she was adjudicated. All interstate compact transfers must comply with federal guidelines enacted by the Interstate Commission for Adult Offender Supervision (ICOAS). Additionally, all interstate compacts must be initiated and monitored through the Interstate Compact Offender Tracking System (ICOTS).

Out of state transfer requests consist of two parts; the request for reporting instructions and the transfer request. Defendants who qualify for reporting instructions will be allowed to leave and return to the state in which they reside after sentencing. Defendants who do not qualify for reporting instructions will be subject to a 45 day investigation period which is conducted by the state receiving the transfer request. During this 45 day investigation period, defendants may not be in the state that is investigating the transfer request.
