Leavenworth man sentenced to 40 months in prison for attempted aggravated battery

Douglas County District Attorney Suzanne Valdez today announced that Howard C. Levite Jr., 32, of Leavenworth, was sentenced to 40 months in the Kansas Department of Corrections in the non-fatal shooting of a man at a Lawrence fast food restaurant in 2019.  

“Gun violence claims more than 120 lives in our country each day,” District Attorney Valdez said. “My office is committed to helping to ensure that no one in our community lives in fear of gun violence.”

Judge Sally Pokorny also sentenced Levite, who pleaded no contest to attempted aggravated battery in May 2024, to 24 months post-release supervision. Levite is to serve the sentence consecutively to an unrelated federal conviction.

Charges stemmed from an incident that occurred on October 26, 2019, when Levite shot a then 50-year-old man following an altercation in the parking lot of McDonald’s, 1309 W. 6th St., Lawrence.

Senior Assistant District Attorney Ricardo Leal represented the State of Kansas. The matter was investigated by the Lawrence Kansas Police Department.
